You undertake that all goods so purchased by you, are for your own private and domestic use only and you accept e-mail as a valid means of communication of any agreement between you and FAB Press.
CONTRACT FOR THE SUPPLY OF GOODS
The display of goods on the FAB Press website amounts to an invitation to treat only and is not an offer to sell goods at any price indicated. No contract for the supply of goods will be deemed to exist between you and FAB Press unless, and until, an e-mail is sent by FAB Press to you confirming that your order has been received. You must check that the details of your confirmation e-mail are correct as soon as possible and you should print out and keep a copy for your records. This confirmation e-mail amounts to an acceptance by FAB Press of your offer to buy goods from FAB Press and this acceptance is effective regardless of whether or not you receive the e-mail.
FAB Press are free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods, any description applied to the goods, the availability of the goods or the order itself.

PROCESSING OF ORDERS
FAB Press aim to ship all items during the next shipping day immediately following receipt of your order. Typically there is one shipping day in each working week (defined as Monday to Friday inclusive), however during busy periods we may ship on two days per working week. If the office is closed for more than one week at any time a notice will be prominently displayed at the home page of the FAB Press informing customers of this fact.
Your order may be delayed if the item is not in stock. Some items may be unavailable. We regret we are not able to supply dates when our suppliers may get an item in stock. We are pleased to be able to offer full order tracking facilities for customers. After you have placed an order, you will be able to check on its status by visiting the FAB Press Online Customer Area, either by clicking the link included in your email order confirmation, or by clicking the link at the top of the website's home page. Please note that your order may be sent to you in instalments.
Credit and debit cards are immediately debited by NetBanx or PayPal on behalf of FAB Press when you place your order. This payment process is valid for all orders, including pre-orders. Books and magazines are zero-rated for Value Added Tax (VAT), however all other goods offered at this website are subject to VAT for all customers who are purchasing within the European Union. All prices for VAT-applicable goods are shown net of VAT, and the appropriate amount of VAT will be added at the point of sale. Customers ordering from outside the European Union are not required to pay VAT.
Shipments to your delivery address may be subject to import duties and taxes which are levied once a shipment reaches your country. Any such additional charges to clear customs must be borne by you. You should note that customs policies vary widely from country to country so we advise that customers contact their local customs office for further information. Note that international shipments are subject to opening and inspection by customs authorities.
Our standard Returns Policy applies to all purchases from FAB Press.
WEIGHT OF GOODS AND COST OF DELIVERY
The cost of delivery is determined according to the currently applicable rates charged by Royal Mail for the UK, and either Royal Mail Airmail or Surface Mail for customers outside the UK. The amount paid for shipping is determined in accordance with a weight-based system. Full details of Royal Mail's shipping rates are shown at the Royal Mail website, which can be accessed via this link. Typical shipping times to addresses outside the UK are 4 to 10 days for Royal Mail Airmail and 2 to 6 weeks for Surface Mail. Each item for sale at this website has been allocated a weight, by reference to which the total weight of each order can be calculated for the purpose of determining the amount to be paid for delivery. The weights shown have been rounded up to the nearest 5g.
Services used for deliveries to addresses within the UK:
Royal Mail First Class or Second Class up to a package weight of 2000g. All packages above this weight are sent by UK Mail.
Services used for deliveries to address outside the UK:
All packages containing only books or magazines are sent by the Royal Mail Printed Papers Airmail or Surface Mail service.
All packages containing T-shirts, CDs or DVDs are sent by the Royal Mail Small Packet Airmail or Surface Mail service.
FAB Press levies a packaging charge of £1.00 (or equivalent in US Dollars or Euro) for each customer's order. This charge is a flat rate per order placed, regardless of how many items are bought with a single payment.
LOST MAIL
Occasionally items go astray during delivery to customers. We will of course send out replacement items if it becomes clear that items have been lost en route to a customer. However, we have found that more often than not, rather than being lost, items that do not arrive in a reasonable time are delayed in the mail, and do eventually arrive. Therefore we do not consider an item to be lost in the mail until the following time periods have elapsed:
UK 4 weeks.
Outside the UK 8 weeks.
LIMITATION OF LIABILITY
This liability section applies only to the extent permitted by law.
Except as set out below, neither FAB Press nor any of their employees or other representatives will be liable for damages arising out of or in connection with the use of this site.
FAB Press does not limit its liability for death or personal injury to the extent only that it arises as a result of negligence of FAB Press, its directors, employees or other representatives.
FAB Press does not accept liability (except as set out below) for any errors or omissions and reserves the right to change information, specifications and descriptions of listed goods, products and services.
In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, FAB Press shall, at its own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund you the amount you paid for the goods in question PROVIDED THAT you notify FAB Press of the problem in writing to care@fabpress.com within 7 days of delivery of the goods, and PROVIDED THAT, if the problem is in respect of defective DVDs and CDs, you return the goods for our inspection prior to their replacement, as any claims for defective DVDs or CDs must be ratified by FAB Press before such goods are replaced or the amount you paid for the goods in question is refunded.
Customers have the right to cancel the contract without penalty for up to seven days starting on the first day after receipt of goods. CDs and DVDs that are supplied in sealed packaging do not need to be accepted back within this time frame unless their packaging is intact.
FAB Press does not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of or damage to property and/or loss from claims of third parties arising out of the use of the FAB Press website or for any products purchased from the FAB Press website. FAB Press will only be liable for direct loss up to a maximum total of the price of the product purchased in respect of any claim.
ILLEGAL ACTS
It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law.
GOVERNING LAW
Purchases from FAB Press are subject to British Law.
PRIVACY POLICY
As a responsible online store we're committed to protecting your privacy. We will only use the information that we collect about you lawfully.
We collect information about you for two reasons: firstly, to process your order and second, to provide you with the best possible service.
We will give you the chance to refuse any marketing email from us. We will not e-mail you in the future unless you have given us your consent except in relation to any orders you have placed with us.
So that we can process orders we will collect information about you that includes your name, address, phone and email address. We do not store credit or debit card details.
We will never collect sensitive information about you without your explicit consent. For the purposes of order tracking we also store details of customer's previous orders with us.
If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.
We use technology to track the patterns of behaviour of visitors to our site. This includes using a "cookie" which is be stored on your computer's hard drive. The cookie we use stores no personal details about you, it simply identifies you to our shopping-cart system.
